پیام به اجلاس سالانه سازمان جهانی كار درژوئن ٢٠١٣

با درودهای فراوان به هیاتهای نمایندگی كارگران شركتكننده در این اجلاس
و با تشكر از دوستان در كنفدراسین بین‌المللی كارگران (ituc) كه از كانون مدافعان حقوق کارگر، به عنوان نهاد كارگری مستقل از ایران برای حضور در این اجلاس، دعوت به عمل آورده‌اند.
متاسفانه امسال نیز همانند سال‌های قبل کارگران ایران نتوانستند نمایندگان واقعی خود را برای شرکت در این اجلاس انتخاب کنند، در نتیجه کارگران ایران هیچ نمایندهای در این اجلاس ندارند. ما نیز نتوانستیم نمایندگان خود را به این اجلاس بفرستیم، زیرا یکی از نمایندگان ما برای حضور در اجلاس آی ال او، (فریبرز رییس دانا) ممنوع الخروج و پاسپورت وی توقیف شده است. نماینده‌ی دیگر (هاله صفرزاده) نیز با انواع تهدیدها و نگرانی برای رفتن و بازگشتن به ایران رو به روست.
ما در سال گذشته، گزارش خود را از وضعیت كار در ایران ارائه دادیم كه به عنوان سند در اجلاس سال گذشته مطرح شد. اكنون با تاكید بر همان گزارش، مطالب ذیل را جهت آگاهی از وضعیت كارگران در طی سال گذشته بیان می‌كنیم:
١- سال گذشته اقتصاد ایران تورمِ با نرخ ۴۵ درصدی را در حوزه‌ی کالاها و خدمات مصرفی شهری تجربه کرده و متوسط نرخ تورم برای کالاها و خدمات اصلی مورد نیاز کارگران ایران، مانند مسکن (در نقاط فقیرنشین) و مواد غذایی عادی مانند حبوبات، لبنیات و گوشت قرمز و سفید، بالاتر از ۴۵ در صد بوده است و هزینه‌ی درمان و دارو با افزایش غیر قال تصوری روبه رو شد، به گونه ای كه سهم کارگران برای پرداخت این هزینه‌ها در حدود ٧٠ درصد شد و تنها ٣٠ درصد این هزینه ها را سازمان تامین اجتماعی می پردازد كه در این بخش نیز كارگران ایران با تورم بالاتر از متوسط ۴۵ درصد مواجه بوده اند.
سال گذشته در پی ضربه‌ای که از ژانویه ٢٠١٣ به خاطر تحریم گسترده‌تر نفتی ایجاد شد، نرخ‌های ارز بیش از سه برابر شدند. نرخ دلار ١١٠٠ تومانی به ٣۵٠٠ تومان بالغ شد. این امر صادرکنندگان را واداشت که کالاهای سنتی را به خارج صادر و از دسترس مردم خارج کنند. دولت به این سیاست یاری رساند. اما کالاهای وارداتی چون دارو، قطعات صنعتی و برخی مواد غذایی گران شدند و بار این گرانی به دوش کارگران افتاد. سیاست های واردات با انگیزه های سیاسی و یارگیری دیپلماتیک موجب تعطیلی واحدها و گسترش بیکاری شده است. از این سیاست ها هم سیاستمداران و هم بازرگانان ایران سود می‌برند.
فرار سرمایه، فساد و زد و بند در ایران ادامه دارد و این امر موجب رکود و بیکاری (همراه با تشدید تورم شده است. سال گذشته فقط معادل ١٠٠٠ میلیارد تومان اختلاس در دادگاه‌هایی مورد بررسی قرار گرفت که رسانه‌های دولتی آن را به نمایش گذاشتند. رقم واقعی به چند برابر این مبلغ می‌رسد.
٢- بالا رفتن نرخ ارزهای خارجی به طور موج‌وار همه‌ی عرصه‌های اقتصاد را در نوردید و موجب گرانی عمومی شد. دستمزدهای واقعی متوسط کارگران به حدود ۴۵ درصد دستمزدهای سال پیش افت کرد و برخی مواقع حتا به ٣٠ درصد نیز رسید. به گونه ای که حقوق کارگران در سال گذشته معادل ٣٠٠ دلار در ماه و امسال نیز علیرغم ده الی ١۵ درصد افزایش ظاهری به حدود ١٢٠ دلار درماه رسیده است.
٣- درعین حال برای تعیین حداقل دستمزد هنوز نمایندگان واقعی کارگران همانند گذشته در كمیته‌های تعیین دستمزد حضور ندارند و حتا سه جانبه‌گرایی موجود در قوانین نیز عملا بی‌ معناست. این اتحاد ِدولت و کارفرمایان است که بر دستمزدها فرمان می‌راند.
۴- بیکاری از مرز ۵.٧ میلیون نفر گذشته است و بیشتر این بیکاران، کارگران جوان هستند. نرخ بیکاری عمومی در حدود ١٩ درصد و نرخ بیکاری جوانان ٢٧ درصد و نرخ بیکاری کارگران زن بیش از ٢۴ درصد برآورد می شود.
۵- کماکان به اعتراض‌های کارگران بیکار و کارگرانی که از ٦ تا ١۴ ماه حقوقی نگرفته‌اند، بی‌اعتنایی شده است. حق تشکل ، تظاهرات و اعتصاب همه و همه نادیده گرفته شده و کارگرانی که به این کارها اقدام می كنند، بلافاصله از کار اخراج شده و بسیاری از آنان در رده‌ی خرابکاران، جاسوسان و توطئه‌گران و براندازان نظام قرار می‌گیرند.
٦- امنیتی بودن و نظامی بودن فضای کار برای مقابله با هر نوع تشکل روز به روز تشدید می شود به خصوص در صنایع بزرگ.
٧- فعالان كارگری همچنان در زندان هستند. ازجمله شاهرخ زمانی، محمد جراحی و رضا شهابی دوران زندان خود را می‌گذرانند و بهنام ابراهیم زاده نیز كه به خاطر بیماری فرزندش در مرخصی به سر می‌برد، بارها به زندان احضار شده است. علاوه بر آن تعداد زیادی از فعالان كارگری همچنان در زیر احكام سنگین قرار دارند كه پرونده آنها در جریان بازرسی است. بسیاری از روزنامه نگاران، معلمان و سایر فعالان اجتماعی و صنفی نیز یا مشغول گذراندن سال‌های حبس خود هستند یا در انتظار نهایی شدن حکم دادگاه برای گذران محکومیت خود به سر می‌برند. مانند رسول بوداغی(معلم)، مهدی شاندیز(معلم)، کیوان صمیمی(روزنامه‌نگار)، مسعود باستانی (روزنامه‌نگار)، مهسا امرآبادی (روزنامه‌نگار) و...
٨- تبعیض جنسیتی و قومیتی هم چنان در محل‌های کار ادامه دارد. این تبعیض‌ها بسیار گسترده و متنوع هستند. بر طبق گزارش‌های موثق ِ منابع مستقل ، حقوق زنان در بسیاری موارد بویژه در کارگاه های کوچک تا یک سوم حقوق مردان، برای کار برابر است. همچنین برخی از کارگران مهاجر به خصوص کارگران افغان از دستمزدهای بسیار اندک برخوردارند. از طرف دیگر در پروژه ‌های نفتی، کارگران خارجی، دستمزدهایی به مراتب بالاتر از کارگران بومی دارند و این وجه دیگری از تبعیض است که در آن به دلائل سیاسی ، حقوق یک متخصص کشورهای طرف قراردادهای نفتی تا چند برابر حقوق کارگر متخصص داخلی با تخصص یکسان است.
٩- حقوق معوقه هم چنان یکی از مسایل مبرم جامعه ی کارگری ایران است که باید هر چه زودتر به آن پرداخته شود. در پروژه های بزرگ پرداخت حقوق هر چند ماه یک بار به امری متداول تبدیل شده است. در این پروژه‌ها اقدام دسته‌جمعی برای دریافت حقوق (اعتصاب و اعتراض) ، معمولا تنها منجر به دریافت بخشی از دستمزد و اخراج سردمداران اعتراضات می شود. کارگران بسیاری تنها به خاطر درخواست دریافت حقوق عقب افتاده شان، از کار بیکار شده و در لیست سیاه استخدام مجدد قرار گرفته‌اند و به این دلیل عملا امکان یافتن مجدد کار برای آنان بسیار کم می‌شود و از این رهگذر خانواده های آنان دچار مشکلات بیشماری می‌شوند. معمولا کارفرمایان همیشه بخشی از حقوق و دستمزد کارگران را نگه می‌دارند. در کارگاه‌های کوچک و بنگاه‌ها و شرکت های خصوصی نیز این امر متداول است. حتا در بیمارستان‌های دولتی ، دستمزد پزشکان نیز با تاخیر پرداخت می‌‌شود. دستمزد معلمان حق‌التدریسی نیز هر چند ماه یک بار پرداخت می‌گردد. در بسیاری از مدارس خصوصی نیز حقوق معلمان با تاخیرهای چند روزه تا چند ماهه پرداخت می‌شود.
١٠- خارج شدن بخش وسیعی از کارگران از شمول قانون کار (کارگاه هایی كه زیر ده نفر نیروی کار در استخدام دارند) دست کارفرمایان را در اجحاف هر چه بیشتر به کارگران باز گذاشته وعملا این بخش از کارگران که بخش وسیعی از کارگران را تشکیل می دهند در بی حقوقی کامل به سر می برند.
١١- قراردادهای سفید امضا همچنان برقرار بوده و به این وسیله هر زمان که کارفرما اراده کند، می‌تواند نیروی کار را اخراج کند.
١٢- آموزش و بهداشت در ایران هر روز بیش از پیش از دسترس کارگران و زحمتکشان خارج می‌شود، به طوری که بر طبق آمار موثق، بیش از سه میلیون کودک بازمانده از تحصیل در ایران وجود دارد که اینان به دنیای کار وارد شده و هر روزه تعداد کودکان کار افزایش می یابد. این میزان یکی از بالاترین میزان كودك كار در سراسر جهان است و هیچ چشم‌اندازی برای تغییر آن در کوتاه‌ مدت وجود ندارد.
١٣- حوادث کار در ایران یکی از خونبارترین حوادث کار درجهان است. به طورمتوسط هر ساعت چند کارگر آسیب می بینند که همه ی اینها ناشی از فقدان ایمنی و بهداشت در محیط کار و سودطلبی کارفرمایان است. در پروژه های نفت و گاز یا پروژه ‌های بزرگ، در نظر گرفتن چندین کشته در برنامه‌ریزی‌های ابتدایی جزو پیش بینی‌های عادی است.
١۴- در خاتمه یادآور می‌شویم که یکی از خواسته‌های واقعی کارگران و فعالان کارگری مستقل، همواره این بوده است که در نشست‌های بین المللی مربوط به كار و كارگر نمایندگان واقعی و مستقل کارگران ایران، جایگزین تشکل‌های دولتی وغیرمستقلی شوند که به عنوان نماینده‌ی کارگران ایران در این اجلاس شرکت می کنند.
متاسفانه از سوی آی ال او هیچ گاه به این موضوع توجه جدی نشده است و همین مساله باعث شده به جای نمایندگان واقعی کارگران نمایندگان دولتی و خود خوانده در طی سی سال گذشته، همواره در این گونه اجلاس حضور داشته باشند و مطالبات و مسایل کارگران ایران به درستی شنیده نشود. این مساله برای همیشه باید حل شود و نمایندگان واقعی کارگران ایران در این اجلاس حاضر شوند.
١۵- ضمن حمایت جدی از خواسته کارگران سراسر جهان، به خصوص اعترضات یک سال گذشته در سراسر اروپا و آسیا و امریکا که خواهان طرد سیاست‌های ریاضت اقتصادی بوده و هستند، خواهان حمایت کارگران واتحادیه های کارگری دنیا از مبارزات به حق کارگران ایران هستیم.

Message of the Workers' Rights Defenders Association (WRDA) to the annual
Meeting of International Labor Organization, June 2013

With abundance of greetings to the representatives of labor delegations participating at this meeting And, thanks to the friends at International Trade Union Workers’ Confederation (ITUC) who invited the Center for the Workers' Rights Defenders Association to participate in this meeting as an independent workers’ organization from Iran.
Unfortunately, this year, like last year, there is no representative from workers of iran in that meeting, and we were unable to send our representative to this meeting, because one of our representatives to the ILO meeting (Fariborz Raees-Dana) was banned from leaving the country and his passport was seized. The other representative (Haleh Safarzadeh) too is facing various threats and concerns regarding traveling to and from Iran.
In the past year, we provided our report regarding the labor conditions in Iran which was presented as a document at the meeting. Now, emphasizing on the same report, we inform you of the state of the workers in the past year. 1- Last year, Iranian economy experienced 45 percent inflation in the commodities and municipal consumer services sectors, and average inflation rate for basic services and commodities needed by Iranian workers such as shelter (in poor neighborhoods), and regular food such as grains, dairy, red and white meat, was over 45%, the cost of health and medicine was faced with unbelievable rise, to a point where workers’ share of the cost was approximately 70%, of which the Social Insurance pays only 30 percent, the Iranian workers were faced with more than average 45% inflation rate.
Following the shock of January 2013 caused by the widespread oil sanctions, the foreign currency exchange rates tripled. The US dollar which was 1,100 tomans jumped to 3,500 tomans. This forced the exporters to take the traditional commodities out of peoples’ hands and send them abroad. The government helped this policy. However, because items such as medicine, industrial parts and some food items were imported, they became expensive and the load of such expenses fell on workers shoulders. The importing policies with political motives and diplomatic quid pro quos caused closures of production units and created unemployment expansions. Iranian politicians and merchants enjoyed that policy.
Investment frights, corruptions and red tapes continued in Iran, which has caused depression and unemployment along with escalation of inflation in the country. Last year, the Iranian courts reviewed fraud cases of over 1,000 billion tomans which were showcased by the government media. The real figures amount to several times more than what was announced.
2- The effects of rise in foreign currency exchange rates rippled through all economic sectors and created general price raise. The average or real wages of workers dropped to 45 percent compared to last year’s values, and at times dropped to as low as 30%. It went to a point where workers’ wages equaled $300 per month and despite apparent increase of 10 to 15% of their wages this year, it is only $120 per month now.
3- At the same time, yet as before, in setting the minimum wage, the real representatives of the workers were absent in wage control committees and even the present three-point approach in the laws is practically meaningless, only the collaboration of the government-employer rules.
4- The unemployment rate is over 5.7 million, most of them young. The general average rate is approximately 19 percent, unemployment among youth is 27% and rate of unemployment among female workers is estimated at over 24 percent.
5- The objections of unemployed workers’ and the protests of workers who have not received their wages for 6 to 14 months are still ignored. The rights to organize, demonstrate and strike are ignored, workers who attempt them are immediately fired and many of them are branded as agitators, spies, conspirators and insurgents.
6- To fight against any type of organization, the working environment at large industries have become increasingly militarized and security prone.
7- The labor activists are still in jail, including Shahrokh Zamani, Mohammad Jarrahi and Reza Shahabi who are serving their sentences. Behnam Ebrahimzadeh who is on leave due to his child’s illness has been repeatedly summoned to jail. Furthermore, a large number of labor activists are charged with threatening accusations, and their cases are ongoing. Many journalists, teachers and other social trades activists are either serving their sentences or are awaiting the final court decisions regarding their sentences; among them, Rasoul Boudaghi (teacher), Mehdo Shandiz (teacher), Keyvan Samimi (journalist), Masoud Bastani (journalist), Mahsa Amerabadi (journalist), and …
8- The gender and ethnic discrimination at work place still continues. These discriminations are colorful and widespread. According to reliable and independent sources, women’s wages in many cases especially in small workshops is only up to one third of men’s for equal work. As well, some immigrant workers particularly Afghan laborers receive very little in wages. On the other hand in oil projects, foreign workers receive salaries several times more than local workers which are another aspect of discrimination. For political reasons, the salary of a professional from a country with oil contract is several times more than the salary of the local person with the same professional expertise.
9- The unpaid wages are still one of the most important issues facing the Iranian workers’ community, which must be paid as soon as possible. In large projects, payment of once-every-few-months has become a normal pattern. In such projects, a collective action to receive overdue wages (protest and strike) usually results in partial payment of the overdue wages and expulsion of the leaders of the action. Many workers demanding their overdue wages, became unemployed and were placed in employment black list, which practically highly reduced their chances of being re-employed, and for that reason, their families suffer from immense difficulties. Usually employers keep a portion of workers’ wages and salaries. There is a same trend in small workshops and private companies. Even in government hospitals doctors’ salaries are paid with delays. The salaries of teachers are also paid once in every few months. In many private schools, teachers’ wages and salaries are paid with delays of few days to few months.
10- Removal of vast sections of workers from the Labor Act (workshops with less than 10 employees) has opened the employers’ hands in discriminating against workers. Practically, these workers, which constitute a large portion of the work force, are in a complete lawless state.
11- Blank contracts are still in existence which entitles the employers to fire workers whenever they wish to do so.
12- Education and health in Iran are getting farther and farther from the reaches of the workers on a daily basis. This is to such point that according to reliable sources, more that 3 million children are prevented to study in Iran, they eventually enter the work force and increase child labor rates every day. This is one of the highest ratios of child labor in the world and no short term improvement is forecasted.
13- Work related incidents in Iran are among deadliest in the world. On average, few workers injure every hour, all as result of lack of security and safety measures at work place and employers’ greed. In oil and gas or other large projects, forecasting few deaths is a norm in preliminary planning.
14- At the end, we would like to remind you that one of the real demands of workers and independent worker activists has always been that in the international meetings related to labor and workers’ issues, the real representatives of independent workers of Iran to replace the government and affiliated workers’ organizations who participate as representatives of Iranian workers. Albeit, this issue has never been seriously paid attention from ILO to and in the past thirty years, the government representatives and self-nominated have always taken the place of the real Iranian workers in such sessions and as a result, the issues and demands of the Iranian workers were not properly heard. This issue must be resolved once and for all, and the real Iranian workers’ representatives must be present in these sessions.
15- Further to serious support of demands of workers around the world, especially the protests in Asia, America and Europe in the past year demanding eradication of economic austerity policies, we demand the support of the world’s workers and labor unions regarding the rightful demands of Iranian workers.
